Which Incoterms apply in 2026?
As of 2026 the edition in force is Incoterms® 2020. The ICC has not published an “Incoterms 2026”. Work on the next edition, Incoterms® 2030, is under way; according to ICC national committees it is planned for late 2029. In new contracts, state the rule, the named place and “Incoterms® 2020”.
What are Incoterms 2020?
Incoterms are 11 rules published by the International Chamber of Commerce (ICC) that set out how costs, risk and responsibility are divided between buyer and seller.
Any mode of transport
EXW, FCA, CPT, CIP, DAP, DPU, DDP. DPU replaced DAT in 2020.
Sea and inland waterway only
FAS, FOB, CFR, CIF.
Where risk transfers
| Rule | Risk transfers |
|---|---|
| EXW | At the seller's premises |
| FCA | When delivered to the buyer's carrier |
| CPT / CIP | When handed to the first carrier |
| FAS | Alongside the ship |
| FOB / CFR / CIF | On board at the port of shipment |
| DAP / DPU / DDP | At the destination |
Insurance difference
Under the 2020 rules, CIP requires all-risks cover (ICC A), while CIF still requires only minimum cover (ICC C).
Edition history in brief
The ICC published the first rules in 1936 and revised them in 1953, 1967, 1974, 1980, 1990, 2000, 2010 and 2020. In 2010 DAF, DES, DEQ and DDU were removed and DAT and DAP introduced; in 2020 DPU replaced DAT. An older edition can still apply if the contract names it expressly, but new contracts should refer to the current edition.
Choosing the right rule determines who pays for transport, handles customs and bears the risk of damage. In a contract, always add the named place and the words "Incoterms 2020" next to the rule. For containerised cargo, FCA is often preferred over FOB. Ertaş Global Logistics can help prepare a quote for your chosen delivery term.
